Official Rules

The Canada’s Safest Driver Contest (hereinafter “Contest”) is designed to (i) promote safe driving; (ii) improve road safety; (iii) provide insight into how telematics can improve driver safety; and (iv) increase awareness of and participation in Parachute Vision Zero initiatives.

The Contest is a contest of skill that measures the driving habits of entrants through the Canada’s Safest Driver telematics app (hereinafter “App”) developed for the Contest by Cambridge Mobile Telematics, Inc. (hereinafter “CMT”).

The Contest is sponsored and administered by Parachute Leaders in Injury Prevention, located at 150 Eglinton Avenue East, Suite 300, Toronto ON, M4P 1E8 (hereinafter “Parachute”), by Certas Home and Auto Insurance Company and Certas Direct Insurance Company, each located at 6300 Boulevard Guillaume-Couture, Lévis, QC, G6V 6P9 and by Desjardins General Insurance Inc., located at 3 Robert Speck Parkway, Suite 550, Mississauga, ON  L4Z 3Z9 (hereinafter “Desjardins Insurance”) (hereinafter collectively referred to as “Contest Administrators”).

Contest Period

The Contest runs from 12:00 am on October 1, 2020 to 12:00 am on November 26, 2020 (EST).

Eligibility

To be eligible, entrants must:

  1. be an individual with a valid driver’s licence; 
  2. reside in Canada; and
  3. have reached the age of majority in their province or territory of residence at the time of entering the Contest;

To enter the Contest, individuals must:

  1. download the App to their wireless device; 
  2. provide all of the requested information and registration requirements in the App, including their primary personal email address; 
  3. create a username in the App; and 
  4. accept all of the terms and conditions regarding the downloading and usage of the App and any rules relating to the Contest contained in the App.

Employees, representatives and agents of CMT and Parachute as well as anyone domiciled with said employees, representatives or agents, may not enter the Contest. 

Employees, representatives and agents of Desjardins Insurance, or those of any other entity that is part of Desjardins General Insurance Group Inc. or one of its subsidiaries, as well as anyone domiciled with said employees, representatives or agents, may not enter the Contest. 

Entry and participation in the Contest are free.  

An entrant can withdraw from the Contest at any time by logging out of, deactivating or deleting the App.  

Any additional or fraudulent entry by an entrant will be automatically void.

The Contest Administrators have the right to disqualify any entrant or cancel an entry that does not comply with the Official Rules. 

Collection, Use, Disclosure and Ownership of Data

All of the information of entrants collected in the App and all driving data produced during the Contest will be (i) used to power the Contest and determine the prize winners; and (ii) used in accordance with CMT’s privacy policy, available for viewing at www.cmtelematics.com/company/privacy.

By downloading the App and participating in the Contest, all entrants unconditionally agree to the sharing of all of the information collected in the App at the time of or after registration and all driving data produced during the Contest with CMT.  Driving data includes, but is not limited to, speed, acceleration, braking, cornering, and phone usage.

All of the information of entrants collected in the App at the time of or after registration, all data produced during the Contest, all anonymous aggregate data and other information collected or produced by or in the App is owned by CMT.

The name and email addresses of prize winners shall be disclosed by CMT to the Contest Administrators.

Prizes

A total of $19,000.00 (CAN) shall be awarded as prizes during the Contest, as indicated in the text and chart below.  

The Contest has five (5) entry periods (“each an Entry Period”) with a corresponding prize as follows: 

(a) Grand Prizes

Three (3) grand prizes to be awarded to entrants that enter the Contest before 12:00 am on October 14, 2020 and that obtain the three best overall driving scores on the App between 12:00 am on October 15, 2020 and 12:00 am on November 26, 2020 (EST) (hereinafter the “Grand Prize Period”), the grand prizes consisting of the following (hereinafter collectively referred as the “Grand Prizes”);

Entry Period 1:  One (1) grand prize of $10,000.00 (CAN) to be awarded to the entrant that obtains the best overall driving score on the App during the Grand Prize Period (hereinafter the “Grand Prize”); 

Entry Period 1:  One (1) second place prize of $5,000.00 (CAN) to be awarded to the entrant that obtains the second best overall driving score on the App during the Grand Prize Period; and

Entry Period 1:  One (1) third place prize of $2,000.00 (CAN) to be awarded to the entrant that obtains the third best overall driving score on the App during the Grand Prize Period;

(b) Additional Prizes

Four (4) additional prizes to be awarded of $500.00  (CAN) each to entrants that enter the Contest as follows:

Entry Period 2:  One (1) prize of $500.00 (CAN) to be awarded to the entrant that obtains the best overall driving score on the App between 12:00 am on October 1, 2020 and 12:00 am on October  15, 2020 (ET) (hereinafter the “Pre-Grand Prize”);

Entry Period 3:  One (1) prize of $500.00 (CAN) to be awarded to the entrant that obtains the best user score on the App for avoiding distractions for the period between 12:00 am on October 15, 2020 and 12:00 am on October 29, 2020 (ET) (hereinafter the “Least Distracted Driver Prize”); 

Entry Period 4:  One (1) prize of $500.00 (CAN) to be awarded to the entrant that obtains the best user score on the App for complying with posted speed limits between 12:00 am on October 29, 2020 and 12:00 am on November 12, 2020 (ET) (hereinafter the “Posted Speed Limit Prize”); and

Entry Period 5:  One (1) prize of $500.00 to be awarded to the entrant that obtains the best user score on the App for smooth braking between 12:00 am on November 12, 2020 and 12:00 am on November 26, 2020 (ET) (hereinafter the “Smooth Braking Prize”).

In order to be eligible to win a prize, an entrant must:

(a) have entered the Contest by the beginning of the prize period for that prize; and

(b) have driven at least fifty (50) kilometres during the prize period for that prize.

Being first on one of the leaderboards of the App does not guarantee that an entrant will win the prize related to that leaderboard.   

No prizes shall be awarded in relation to any driving or driving data collected by the App after 12:00 am (ET) on November 26, 2020.The period after 12:00 am (ET) on November 26, 2020 shall be strictly for entrants who want to continue to monitor their driving behaviour until the end of the Contest period.  The driving behaviour and data collected by the App after 12:00 am (ET) on November 26, 2020 will also be used to further analyze driving behaviour.  

In the event that two or more entrants tie for one or more of the Grand Prizes, the awarding of the prize(s) shall be determined by the following:

(a) the prize(s) shall be awarded in the order in which the entrants entered the Contest from earliest to latest; 

(b) if the method outlined in paragraph (a) does not break a tie, the prize shall be awarded to the entrant who drove the greater or greatest distance during the time period for the Grand Prizes. 

In the event that two or more entrants tie for the Pre-Grand Prize, the Least Distracted Driver Prize, the Posted Speed Limit Prize or the Smooth Braking Prize, the awarding of the prizes shall be determined by the following:

(a) the prize shall be awarded to the entrant with the best overall score at the end of the prize period; 

(b) if the method outlined in paragraph (a) does not break a tie, the prize shall be awarded to the entrant who entered the Contest first;

(c) if the method outlined in paragraph (b) does not break a tie, the prize shall be awarded to the entrant who drove the greater or greatest distance during the prize period. 

An entrant shall not be eligible for a prize if they withdraw from the Contest prior to the end of the relevant entry period of a prize.

Prize winners shall be selected on the dates and times set out in the chart above at 150 Eglinton Avenue East, Suite 300, Toronto ON, M4P 1E8.  Prize winners shall be advised that they have won a prize by email sent to their primary personal email address provided when they  entered the Contest.  

A potential prize winner must respond within the time period communicated to the potential prize winner by the Contest Administrators.  The Contest Administrators may, at their sole discretion, choose another prize winner for the prize in question if the potential prize winner fails to respond to the email informing them that they have won a prize.  

Prizes shall be awarded in the form of a cheque.  No substitution of a prize is allowed.  

Prizes will be awarded to the prize winner only. Prize winners of one of the three (3) Grand Prizes are also eligible to win one (1) or more of the Additional Prizes.  Prize winners may be requested to provide the Contest Administrators with proof of their identity.  Prize winners will be required to provide their full legal name and address to enable the Contest Administrators to mail them their prizes.  Prizes are not transferable, either to another person or to the successors or heirs of the prize winner.  

Prizes shall be mailed by the Contest Administrators to prize winners within six (6) weeks of a prize winner being deemed a prize winner and meeting all of the requirements of the Official Rules.  

The Contest Administrators and CMT shall not be responsible for any lost or stolen prizes.  

In order to receive their prize, a prize winner must execute a release that allows the Contest Administrators to use the prize winner’s name, geographical region, photograph, voice and, if requested, a video of them in any advertisement or promotion involving the Contest, in all forms of media, worldwide, in perpetuity, and without any further compensation.

Any prize winner that fails or has failed to comply with the Official Rules shall be disqualified as a prize winner.  The prize shall then be awarded to the entrant(s) with the next best score for the prize in question.  

Acceptance and Compliance with the Official Rules

By entering the Contest, all entrants are deemed to unconditionally accept all of the Official Rules.  

All entrants must comply with and abide by all of the Official Rules at all times as well as any decisions taken by the Contest Administrators relating to the Contest. 

Decisions Regarding the Contest and the Official Rules

All decisions regarding the operation and administration of the Contest as well as the application and interpretation of the Official Rules are solely the responsibility of the Contest Administrators.  

All decisions of the Contest Administrators regarding the Contest and the Official Rules are final, legally binding and are not reviewable by any other body, organization or person, subject, in Quebec only, to any decision of the Régie des alcools, des courses et des jeux du Québec regarding any question within its competence.  

General Provisions

  1. The Contest Administrators reserve the right to modify the Official Rules or terminate the Contest at any time, without notice.  In Quebec only, the approval of the Régie des alcools, des courses et des jeux du Québec is required.
  1. The Contest Administrators reserve the right to disqualify any entrant and refuse to award a prize to an entrant that does not or has failed to comply with the Official Rules or any decision of the Contest Administrators regarding the Contest.
  1. The Contest Administrators and CMT cannot be held liable for lost, misdirected, or late entries, or for any failure, for any reason whatsoever, that may affect the availability or operation of the App or any telecommunications systems and networks for the duration of this Contest.  Moreover, the Contest Administrators and CMT cannot be held liable for any damage to entrants’ wireless devices or to components of wireless devices used to enter this Contest.
  1. The Contest Administrators and CMT assume no responsibility whatsoever in the event they become unable to act as a result of an event or a situation outside of their control or a strike, lockout or any labour dispute in progress within institutions, organizations or businesses whose services are used to conduct this Contest.
  1. By entering this Contest, participants release the Contest Administrators and CMT of any and all liability for any damage that could result from said entry or from the acceptance or use of the prize if a person is declared the winner.
  1. The prize winners recognize that, upon receipt of their respective prize(s), the delivery of the prize(s) becomes the entire and exclusive responsibility of the prize winner and releases the Contest Administrators and CMT of all liability for any damages that could result from the acceptance or use of the prize(s). 
  1. The Contest is subject to all applicable laws.
  1. For Quebec residents only, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for a ruling on any matter under its jurisdiction.  Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
  1. An English and French version of these rules is available on the following Web site: https://parachute.ca.  In the event of a discrepancy between the English and French versions of these rules, the English version shall prevail.
